Establish Duty of Care and Standards Traffic engineers must follow recognized scientific methods and industry standards. The “rate x time = distance” equation is a basic principle, and any deviation, like “x 2.0,” must be scientifically supported and accepted in the field. 2. Challenge the Validity of “x 2.0: Argue that the multiplication factor is arbitrary and not grounded in science. Use expert testimony and reference industry standards (e.g., from the Institute of Transportation Engineers) that do not endorse this method. Point out that accepted guidelines typically omit such a factor. 3. Negligence Per Se Argument If this method violates established standards or guidelines, you could argue negligence per se, focusing on the unreasonable and unsupported departure from accepted practices. 4. Defendant and Legal Cause: The defendant would likely be the government agency responsible for traffic management. You could argue that using a flawed method created an unsafe situation leading directly to the crash. 5.*Responding to “It’s Standard Practice” Defense: Just because a practice is common doesn’t make it reasonable.
